Mana Coach Services have taken the Tramways Union to court for an alleged confidentiality breach.

MANA Coach Services have taken the Tramways Union to court for damages for an unspecified amount of money due to an alleged breach of a settled employment dispute.
The Investigation Meeting was heard by Employment Authority member Gregory Wood at the Employment Relations Authority on Tuesday.
The Manufacturing and Construction Workers Union journal published an article written by the Tramways Union in September last year, that detailed facts of an employment dispute between Mana Coach Services and one of its employees.
The dispute had been referred to the Employment Relations Authority and the issue was settled in mediation on confidential terms.
Mana Coach Services claim the article published in the journal after the settlement breaches confidentiality.
The Tramways Union argue the facts published were already in the public domain.
The article states that the employment dispute began when a driver of the Newlands Depot of Mana Coach Services was “discriminated” against by the company’s human resources manager Marau Russell for joining the the Tramways Union.
The employee who felt discriminated against taped her meetings with Russell.
Authority member Wood’s decision is expected by about February 16. He will issue a legally binding “determination”, which gives his recommended course of action.
Both parties have the right then to challenge the decision and appeal it to the Employment Court.
